LINCOLN, Neb. (KSNB) - The State Appeals Court is upholding the prison sentence of one of four people convicted in the death of a central Nebraska four-year-old.

Dustin Scoville’s conviction was affirmed by the Nebraska Court of Appeals on Tuesday.

Scoville was sentenced to 49-50 years in prison in Kearney County District Court back in 2010 after the death of four-year-old Landon Payne in Minden in 2009.

Scoville was looking for post-conviction relief. He had argued in court documents that his counsel was ineffective and that his sentence was excessive.

The Appeals Court disagreed, upholding the decision made by Kearney County District Court last October.
